Advice on your financial position and the potential options available to you
A divorce financial settlement will set out how all of your assets and liabilities will be shared. This includes:
- Savings and investments
- Valuable items, including cars, furniture and collectibles
- Inherited money
Negotiating on your behalf to try and reach an agreement
Wherever possible, it is preferable to reach a financial agreement out of court. The first step is for both parties to make full financial disclosure to each other. There is a lengthy form to complete and we will work with you to fill it in, ensuring that the right information is included about your assets, liabilities and family.
Once we receive your spouse’s form, we will go through this and check the accuracy with you. We can then discuss with you what you want to achieve from a potential agreement. For example, it may be important to you to keep your home or your pension in the divorce settlement.
We can make proposals to your spouse’s solicitor and enter into negotiations to try and secure the assets that you want and ensure that a fair solution is found.
If you are able to agree on the division of assets with your spouse, we will put this in writing and ask the court to approve and seal it, making a binding financial order. This is a crucial step. Without an order in place, it would be open to your spouse to make a financial claim against you in the future, long after your divorce is finalised.
Alternative dispute resolution
There are alternative ways to reach a divorce settlement agreement, for example mediation. It is best for the family to consider mediation before asking the court to intervene. We can support you through the mediation process and provide advice on potential suggestions for settlement.
A mediator will help you and your spouse explore the options available to you. They will not decide matters however, and any outcome will be one that you have both agreed upon. Mediation has a high success rate and is generally a faster and more cost-effective process than court.
Again, if you are able to reach an agreement, this will be sealed by the court so that you have a binding financial order that you can rely on and enforce if necessary.
There are also other types of alternative dispute resolution available in family law cases, including arbitration and collaborative law. We can work with you to identify the best option and provide you with advice and representation throughout the process.
If an agreement cannot be reached by way of alternative dispute resolution, you can apply to the court for a financial order. We have in-depth experience of litigation in divorce and we will ensure you have the strongest case possible. You will be represented by an expert divorce and financial settlements solicitor.
We will make sure that you are thoroughly prepared beforehand and that you have the support you need throughout.
