Without an order in place, it would be open to your spouse to make a financial claim against you in the future, long after your divorce is finalised.
Alternative dispute resolution
There are alternative ways to reach a divorce settlement agreement, for example mediation. It is best for the family to consider mediation before asking the court to intervene. We can support you through the mediation process and provide advice on potential suggestions for settlement.
A mediator will help you and your spouse explore the options available to you. They will not decide matters however, and any outcome will be one that you have both agreed upon. Mediation has a high success rate and is generally a faster and more cost-effective process than court.
