Prior to mediation, it is necessary to fully disclose your financial position if the aim is to reach a financial settlement. We will go through your finances with you and complete the necessary form as well as checking the form provided by your former partner.

Drafting outcomes from mediation

If you are able to reach an outcome during mediation, the mediator can put this in writing for you within a Memorandum of Understanding, Parenting Plan and Open Financial Statement. The mediator can discuss with you what steps, if any, you then need to take to make the outcome legally binding.

Obtaining orders from the court in the terms decided during mediation

Once you have reached an outcome within mediation, if you want to make it legally binding it needs to be put in writing and approved by the court. This is a crucial step to ensure that your mediated outcome becomes legally binding so that you can rely on it in the future and, if necessary, take steps to enforce it. Having a court order in place also means that you both have a clear record of the outcome reached, so that future misunderstandings and disagreements can be avoided. If you have reached an outcome using a mediator from a firm other than Family Law Partners you can instruct one of our lawyers to prepare the necessary documents you will need to make the outcome from mediation legally binding, liaise with your former partner/their lawyer to finalise the documents and then send to the court for approval.
