Mediation

Mediation can be used to resolve a range of disputes following the breakdown of a relationship, including financial issues, arrangements for children and how shared property will be dealt with.

It is usually a legal requirement to at least consider mediation before asking the court to make a ruling on an issue. This involves attending a Mediation Information and Assessment Meeting, or MIAM. The family mediator will meet with you and your former partner, either together or separately, and explain the mediation process to you. They will go through how it could help you and answer any initial questions you may have.

Unlike court, any result in mediation will be agreed upon by both parties and you will not have an unwanted decision imposed upon you. The process is usually substantially quicker than court, particularly if the family courts have a backlog of cases.

Prior to mediation, it is necessary to fully disclose your financial position if the aim is to reach a financial settlement. We will go through your finances with you and complete the necessary form as well as checking the form provided by your former partner.

We will work with you to identify what you would like to achieve from mediation and give you the advice and support you need throughout the process.

Drafting outcomes from mediation

If you are able to reach an outcome during mediation, the mediator can put this in writing for you within a Memorandum of Understanding, Parenting Plan and Open Financial Statement. The mediator can discuss with you what steps, if any, you then need to take to make the outcome legally binding.

Obtaining orders from the court in the terms decided during mediation

Once you have reached an outcome within mediation, if you want to make it legally binding it needs to be put in writing and approved by the court. This is a crucial step to ensure that your mediated outcome becomes legally binding so that you can rely on it in the future and, if necessary, take steps to enforce it. Having a court order in place also means that you both have a clear record of the outcome reached, so that future misunderstandings and disagreements can be avoided. If you have reached an outcome using a mediator from a firm other than Family Law Partners you can instruct one of our lawyers to prepare the necessary documents you will need to make the outcome from mediation legally binding, liaise with your former partner/their lawyer to finalise the documents and then send to the court for approval.
