Fertility Treatment

Today, many families are created through some form of fertility treatment. Advances in fertility treatment have enabled single parents, same-sex couples, and opposite-sex couples to extend their families through non-traditional routes.

But the legal structures surrounding family law and fertility is complex, and there are a host of issues that people may not consider until they find themselves in a difficult situation.

Our team of specialist fertility solicitors are experienced in advising fertility patients and their families on the different aspects of family law where fertility treatment is a factor. We can help with:

  • Disputes in relation to stored embryos, eggs or sperm
  • Rights to import and export gametes and embryos
  • Storage periods for eggs, sperm and embryos.
  • Posthumous conception issues (where a surviving partner or parent wants to use eggs, sperm or embryos of someone who has died)

We offer flexibility in terms of the type and amount of legal advice appropriate for your case. That may involve us advising and assisting you from the start to the end of your fertility journey. For example, as well as advising you in the event that a dispute does occur, we can also help clarify your legal position before you start any treatment.

In addition to fertility law, our Modern Families team has additional expertise in surrogacy, and advise clients on planning, disputes, parental responsibility and international surrogacy issues.

We are proud supporters of National Surrogacy Week, and support calls for reform to surrogacy laws in the UK to ensure it keeps up with the pace of social change and the demand for surrogacy agreements from couples wishing to have family in this way.
